Mathura’s special SC/ST court verdict: Death sentence to the accused of rape and murder of an eight-year-old Dalit girl

Mathura’s special SC/ST court awards death penalty to man found guilty of kidnapping, rape and murder of a Dalit girl, says this is a rarest of rare case.

Uttar Pradesh: A special SC/ST court in Mathura on Tuesday awarded death penalty to a 50-year-old man for kidnapping, raping and murdering an eight-year-old Dalit girl. Terming the heinous crime as a “rarest of the rare case”, the court said its brutality was shocking to humanity.
Post mortem report revealed
The report of Dr. Sonu Chaudhary, who conducted the post-mortem, found several sharp-edged injury marks on the girl’s private parts. The uterus was badly damaged and there was also internal bleeding in the kidney and liver, which led to her death. The report also revealed that the girl had injuries on her neck and rectum, deep teeth marks on the shoulder and scratches at several places on the body.
The whole matter
This incident is of 26 November 2020. A class two girl from Mathura district had gone to collect wood from the forest with a woman from her village. When she did not return home till late evening, her father lodged a missing complaint. The same night, the body of the girl was found in the forest of Vrindavan area, who was strangulated to death with her own clothes.
Two days later, on November 28, a man from the local village was arrested as the accused.
legal action
The police registered a case against the accused under sections 363 (kidnapping), 376 (rape), 377 (sexual act against natural justice), 302 (murder) and 201 (destruction of evidence) of the IPC. Apart from this, sections of the POCSO Act and SC/ST Act were also imposed.
The charge sheet was filed on January 25, 2021 and the trial began the next month.
Testimony and evidence during the trial
The police presented statements of nine witnesses, scientific evidence and post-mortem reports in the court. During the investigation, it was also found that pieces of the accused’s skin were stuck in the girl’s nails. A female witness from the village also said that the accused had already been molesting the girls.
Court decision
The court of Additional Sessions Judge Brijesh Kumar rejected the plea of the accused that this was his first offence and he should be treated leniently. The court held that the brutality of the crime was so severe that it deserved capital punishment.
The verdict said that the convict should be “hanged to death until he is dead.” Along with this, the court also imposed a fine of Rs 3 lakh 20 thousand on the convict.
